Ephraim Philbrick (1780-1860)

Bond in Rye, New Hampshire - 1817

REV. EPHRAIM6 PHILBRICK  (JONATHAN5, JOSES4, JOSEPH3, JAMES2, THOMAS1)

    This document was written in 1817 and is a bond between Ephraim Philbrick & Reuben Philbrick Jr., both of Rye, New Hampshire.  The document is dated as December 13, 1817 however there is a small scrap of paper sewn with thread to the bottom (see photograph) dated May 15, 1817.  In the lower portion of the document is the signature of Ephraim Philbrick along with two witnesses:  Amos Towle Junior (spelled Juner) and another signature that is difficult to read.

The following is a transcription of this bond:

To all People to whom these Presents shall come

Greeting

Know ye that I Ephraim Philbrick of Rye in the County of Rockingham & State of New Hampshire, Husbandman, am held & firmly bound to Reuben Philbrick Jr of the same Rye, Yeoman, in the sum of five hundred dollars.  For the faithful payment of which sum, I hereby bind myself, my heirs, Executors and administrators.

In testimony whereof I have hereunto set my hand & seal, this thirteenth day December, in the year of our Lord, one thousand eight hundred & seventeen.

Now the condition of this writing obligatory is That if the said Reuben Philbrick Junior shall pay or cause to be paid to the said Ephraim Philbrick, his Executor, administrators or certain attorney the sum of one hundred & thirty eight dollars, in one year from the date hereof, then the said Ephraim shall convey by deed of warranty the land by the said Reuben Philbrick Junior this day by deed sold & conveyed to the said Ephraim, or shall cause said deed of the said Ephraim to be legally annulled & cancelled as a deed of Mortgage then the obligation to be void; otherwise to remain in full force.
